1 Definitions & Scope

In these Terms & Conditions ("Terms"), the following definitions apply:

These Terms apply exclusively to use of the PDF Tools and supplement the general CMCopys Terms of Service where applicable.

2 Acceptance of Terms

IT Act 2000 §43A

By accessing or using the PDF Tools, you confirm that you have read, understood, and agree to be bound by these Terms. Your continued use constitutes ongoing acceptance.

These Terms constitute a legally binding agreement between you and CMCopys under the Information Technology Act, 2000 and the Information Technology (Amendment) Act, 2008.

If you are using the PDF Tools on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3 Description of Services

CMCopys PDF Tools provide browser-based document processing including:

Service Availability

We provide the PDF Tools on an "as-is" and "as-available" basis. We do not guarantee uninterrupted availability. We reserve the right to modify, suspend, or discontinue any tool at any time without prior notice.

File Size Limits

Standard users may upload files up to 100 MB per file. Processing of files exceeding this limit is not guaranteed and may fail without notice.

5 File Upload & Processing

Your Responsibility for Uploaded Files

You are solely responsible for the content of files you upload. By uploading a file, you represent and warrant that:

Automatic Deletion

All Uploaded Files and Processed Files are automatically deleted from our servers within 2 hours of processing. We do not retain, review, or store your documents beyond this period except where required by law.

Encryption in Transit

All file transfers are encrypted using HTTPS/TLS. However, you acknowledge that no method of electronic transmission is 100% secure.

⚠ Warning: Do not upload Aadhaar numbers, PAN details, bank account information, passwords, medical records, or other sensitive personal data unless absolutely necessary and you understand the risks.

6 Prohibited Uses

You must not use the PDF Tools to:

Violation of these prohibitions may result in immediate termination of access and may be reported to law enforcement authorities as required under Indian law.

7 Intellectual Property Rights

Our Intellectual Property

All software, algorithms, source code, UI/UX designs, logos, trademarks, and content comprising the CMCopys PDF Tools are the exclusive property of CM Copys and are protected under the Copyright Act, 1957 and applicable intellectual property laws. Unauthorised reproduction is prohibited.

Your Content

You retain all intellectual property rights in your Uploaded Files. By using the PDF Tools, you grant CMCopys a limited, temporary, non-exclusive, royalty-free licence solely to process your files for the purpose of providing the requested service. This licence expires automatically upon deletion of your files.

CMCopys does not claim ownership of any content you upload.

8 Data Protection & Privacy

Your use of the PDF Tools is also governed by our PDF Tools Privacy Policy, which is incorporated into these Terms by reference.

9 Disclaimer of Warranties

The PDF Tools are provided "as is" and "as available" without any warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

Use of the PDF Tools is at your sole risk. You are responsible for maintaining backups of your original files.

10 Limitation of Liability

IT Act 2000 §79

To the maximum extent permitted under applicable Indian law, CMCopys, its proprietor, employees, or agents shall not be liable for:

In any event, our total aggregate liability to you shall not exceed INR 500 (Indian Rupees Five Hundred only) or the amount you paid for services in the preceding 3 months, whichever is lower.

You agree to indemnify, defend, and hold harmless CMCopys, its proprietor, employees, and agents from and against any and all claims, damages, penalties, losses, and expenses (including reasonable legal fees) arising from:

CMCopys operates as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

13 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.

Jurisdiction

Any disputes arising out of or in connection with these Terms or the PDF Tools shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka, India.

Arbitration

Before initiating formal legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days. If unresolved, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996.

Consumer Disputes

Nothing in these Terms shall limit the rights of consumers under the Consumer Protection Act, 2019, including the right to approach consumer dispute redressal commissions.

15 Modifications to Terms

CMCopys reserves the right to modify these Terms at any time. We will post the updated Terms on this page with a revised "Last Updated" date. Continued use of the PDF Tools after such modifications constitutes your acceptance of the revised Terms.

For material changes, we will endeavour to provide at least 7 days' notice via a notice on the Platform or by email where contact details are available.
